DESIGN ENGAGEMENT

This Agreement establishes the architectural and structural development of your custom residence with FitzGibbons Custom Homes.

We intentionally accept a limited number of projects annually to ensure focused oversight, disciplined management, and a structured design experience. This agreement secures your placement within our design schedule.

Minimum Residence Size: 2,000 Square Feet

SCOPE OF SERVICES

Architectural Development

Design services include:

Initial Layout & Design Meeting – a collaborative working session to establish preliminary floor plan layout, space planning, and structural direction

Concept Floor Plan developed from the Initial Layout & Design Meeting and specified client requirements

• Up to three (3) major structural design revisions prior to completion of Construction Drawings

For clarity, major structural design revisions are defined as modifications affecting the primary structure of the residence, including:

– Roof line changes reflected on plans
– Foundational footprint adjustments
– Significant structural wall reconfigurations
– Substantial layout alterations to an accepted Concept Floor Plan

• Complete Construction Drawing Set, including:

 – Cover Sheet
 – Foundation Plan
 – Floor Plan
 – Roof Plan
 – Exterior Elevations
 – Electrical Plan
 – Interior Elevations (including cabinet layouts)

Engineered Structural Plans

Prepared by ELD Engineering, Inc.

- Slab-on-Grade Foundation Plan - Per Geotechnical Report (Soil Testing)
- Shear Wall Design

Roof and ceiling engineering design are excluded unless otherwise specified in writing.

DESIGN INVESTMENT

Design services are calculated at:

$4.00 per Marketable Square Foot*
(*Square footage as defined by the local Tax Appraisal District.)

With a 2,000 square foot minimum, the minimum design investment is $8,000.

To initiate architectural development and reserve dedicated drafting and engineering coordination time, a:

$4,000 Non-Refundable Design Fee Commitment

is required prior to commencement. This represents 50% of the minimum design investment and formally secures your placement within our active design schedule.

The remaining balance will be calculated upon completion of Construction Drawings and Engineered Drawings, based on finalized square footage, and is due prior to release of the full plan set.

POST-DRAWINGS STRUCTURAL REVISIONS

Structural modifications requested after completion of Construction Drawings require:

• $500 revision retainer
• $150 per man-hour for Architect and/or Engineer revisions (if required)

PLAN OWNERSHIP

Plans are address-specific and prepared exclusively for the homeowner identified above.

Construction Drawings prepared by RickMonte, LLC reserve all common law copyright and property rights. Plans may not be reproduced, modified, assigned, sold, or distributed without prior written consent from RickMonte, LLC and FitzGibbons Custom Homes.

STRUCTURAL WARRANTY

ELD Engineering, Inc. is approved for the Struc-Sure Limited Warranty (10-Year Structural Warranty), the third-party structural warranty provider for FitzGibbons Custom Homes.

By signing below, both parties acknowledge agreement to the terms outlined herein.

CONCEPT ACCEPTANCE ACKNOWLEDGMENT

By signing below, the Homeowner acknowledges that the Concept Floor Plan — developed through the Initial Layout & Design Meeting and subsequent revisions — has been reviewed and accepted as the structural and architectural foundation of the residence.

Structural modifications requested after formal acceptance of the Concept Floor Plan, including roof line changes, foundational footprint adjustments, or significant layout reconfiguration, may require additional design fees and may impact the project timeline.

ACCEPTANCE

By signing below, both parties acknowledge agreement to the terms outlined herein.
